Work Accident & Injury — frequently asked questions
What can an injured worker claim after a workplace accident?+
Compensation for an injury arising out of and in the course of employment, which can cover medical treatment, loss of earnings during recovery, and a lump sum where the injury causes lasting disability. Which scheme applies — employee compensation or state insurance — depends on the employer and the worker's wages.
What should I do immediately after a workplace injury?+
Get medical treatment and make sure the injury is recorded — both in the hospital records and in writing to the employer. A claim is proved on documents, and the two that matter most are the medical record made at the time and the employer's own accident record.
What if the employer or insurer refuses the claim?+
A refusal is not the end of it. Denied and under-paid claims are challenged before the authority or court with jurisdiction, and disputes commonly turn on whether the injury arose out of employment, the extent of disability assessed, or the wage figure used to calculate the award.
Is there a time limit for making a claim?+
Yes. Compensation claims are subject to limitation periods, and notice of the accident is normally expected to be given to the employer promptly. Delay is not always fatal where there is a good reason for it, but it makes a claim harder, so take advice early.
Can I claim if the accident was partly my own fault?+
Often, yes. Employee compensation is not decided the same way as an ordinary negligence claim, and compensation may still be payable where the injury arose out of the employment. There are exceptions, so the specific circumstances of the accident matter.
