NDPS & Drug Offense — frequently asked questions

Why is bail harder to get in an NDPS case?+
Because the NDPS Act adds conditions on top of the ordinary bail test where a commercial quantity is alleged. Section 37 requires the court to be satisfied there are reasonable grounds to believe the accused is not guilty and is unlikely to reoffend on bail — a far higher bar than an ordinary case. Where the quantity alleged is small, that restriction does not apply.
What do small, intermediate and commercial quantity mean under the NDPS Act?+
They are quantity thresholds notified for each substance, and they decide almost everything about a case. Small quantity carries the lightest punishment and ordinary bail rules; commercial quantity carries the heaviest punishment and the Section 37 bail restriction; intermediate quantity sits between them. Establishing which band applies is often the first real battleground in an NDPS defence.
What procedural safeguards does the NDPS Act require during a search?+
The Act requires specific formalities, and failure to follow them can be fatal to the prosecution's case. These include informing the person of their right to be searched before a gazetted officer or magistrate where that applies, recording and reporting the information and the seizure, and drawing and sealing samples in the prescribed way before a magistrate. A defence normally begins by auditing each of these.
Does being a first-time offender or an addict make a difference?+
It can. The Act treats consumption offences differently from possession or trafficking, and contains provisions allowing an addict who volunteers for treatment to be dealt with differently. Whether any of this is available depends on the sections charged and the quantity alleged.
How soon should I involve a lawyer in an NDPS matter?+
Immediately. Much of the defence in an NDPS case is built on what happened during the search, seizure and sampling — events that are over within hours, and which have to be documented and challenged while the record is still fresh.
