Family & Divorce — frequently asked questions

What is the difference between a mutual-consent and a contested divorce?+
In a mutual-consent divorce both spouses agree to end the marriage and agree the terms — maintenance, custody and property — and ask the court to record it. In a contested divorce one spouse petitions on a ground the other disputes, and the court decides after evidence. Mutual consent is substantially faster and less expensive because there is nothing to prove.
How long does a mutual-consent divorce take in India?+
It normally runs over two court motions with a statutory waiting period between them, which is why several months is typical rather than several weeks. Courts can waive that waiting period in cases where the separation is long-standing and the settlement is genuine. The actual timeline depends on the court's schedule and how complete your paperwork is.
Who gets custody of a child after a divorce?+
Indian courts decide custody on the welfare of the child, not on the preference of either parent. The child's age, schooling, emotional ties, and each parent's ability to provide care all weigh in, and custody is frequently shared in some form rather than given wholly to one parent.
What is maintenance, and who can claim it?+
Maintenance is financial support one spouse is ordered to pay the other, and it can also be claimed for a child. It can be granted while a case is pending and again at its conclusion. The amount turns on the income and assets of the paying spouse and the reasonable needs and standard of living of the person claiming.
Will my family matter be kept confidential?+
Yes. Family matters are handled in confidence, and family court proceedings themselves are not open to the public in the way an ordinary civil trial is.
